The “Melissa Odabash Sale” name, logo, and all related product and service names are our trademarks. You may not use any meta tags or any other “hidden text” utilizing our name or trademarks without our express written consent.

1.3 User Obligations: You agree to use the website only for lawful purposes. You are prohibited from posting or transmitting any material that is unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable.

2. Product Information and Service Description

2.1 Product Range: We specialize in curated luxury swimwear, beachwear, and apparel. Our collections include Bikinis, Bandeau tops, Halterneck styles, Full Coverage swimwear, Bralettes, Dresses, Co-Ords, and select Accessories. We also offer exclusive items from our Exclusives, Editions, and Collections lines.

2.2 Product Presentation: We make every effort to display product colors and details as accurately as possible. However, the actual colors you see will depend on your monitor, and we cannot guarantee its accuracy. All products are subject to availability.

2.3 Final Sale Items: To preserve the integrity, exclusivity, and hygiene of our most curated pieces, the following items are marked as FINAL SALE and are not eligible for return or exchange:

• All Swimwear & Beachwear (including Bikinis, Bandeau tops, Full Coverage, and Halterneck styles).
• Items from our Exclusives, Editions, and specified Collections.
• Accessories removed from their original sealed packaging.

We provide detailed descriptions and imagery to assist you in making an informed selection.

3. Orders and Payment Terms

3.1 Order Process: Placing an item in your cart does not reserve it. An order is only confirmed once payment has been authorized and you receive an order confirmation email.

3.2 Pricing: All prices are listed in US Dollars (USD). We reserve the right to adjust prices at any time, but changes will not affect confirmed orders.

3.3 Payment Methods: We accept payments via Visa, MasterCard, JCB, and PayPal. By providing payment information, you represent that you are authorized to use the chosen payment method.

3.4 Order Acceptance: We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or suspected fraud. If we cancel an order, we will notify you and issue a full refund.

4. Shipping and Delivery

4.1 Processing Time: Orders are processed within 1-2 business days (excluding weekends and public holidays) after payment confirmation.

4.2 Shipping Options & Costs:

• Standard Shipping: A flat fee of $12.95 USD via DHL or FedEx. Delivery estimate: 10-15 business days after dispatch.
• Free Shipping: Available on all orders over $50 USD via EMS. Delivery estimate: 15-25 business days after dispatch.

Delivery times are estimates and may vary due to customs procedures. We ship globally, excluding some remote areas and specific regions in Asia.

4.3 User Responsibility for Delivery: Once the package leaves our facility, risk of loss and title pass to you. You are responsible for any import duties, taxes, or customs clearance fees charged by your country.

5. Returns, Exchanges, and Refunds

5.1 Policy Overview: We gladly accept returns and exchanges for eligible items within 15 days of the delivery date. Items must be in original, unworn, unwashed, undamaged condition with all tags and packaging.

5.2 Return Process:

1. Initiate a request by emailing [email protected] within 15 days.
2. Receive an RMA number and instructions from our team.
3. Ship the item(s) securely to our Returns Center at your cost (unless the return is due to our error).

5.3 Refunds: Approved refunds are processed to the original payment method within 10-14 business days. Original shipping fees are non-refundable.

5.4 Damaged or Incorrect Items: Contact us immediately if you receive a damaged, defective, or incorrect item. We will arrange a prepaid return and expedite a replacement or refund.

6. Limitation of Liability

6.1 General Limitation: To the fullest extent permitted by law, Melissa Odabash Sale shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein.

6.2 Product Liability: Our total liability for any claim arising from the purchase of a product is limited to the purchase price of that product.

7. Governing Law and Dispute Resolution

These Terms and Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the United States and the State of California. Any dispute shall be subject to the exclusive jurisdiction of the courts located in Alameda County, California.
